Yes.... probably.
Would be nice if the dev team implement an option in the ACP to disable XHTML compatibility... If I'm depending on full XML compatibility I normaly use a small Javscript.

What would this option do ?
There is no limitation in the custom bbcodes forbidding you to create a new [url_in_new_window] bbcode which would display an old HTML non-compliant code (but IMHO, if you really want URLs to be opened in new windows, use the window.open javascript method instead of the target="_blank" attribute).
Also, nothing forbids you to modify the native [url] bbcode
